Terms And Conditions of Staff Discount
2.1 Employees are required to register as a member of the K11 Design Store (the “Design Store”) via this link https://www.k11designstore.com/corpsales/k11staff/ on the K11DS Website before they can make use of the Discounts when making purchase at the K11DS Website.
2.2 Subject to Clause 2.3 below, Employees are eligible to register as a staff member of the Design Store on the K11DS Website to make use of the Staff Discount.
2.3 Temporary Employees on fixed term temporary contracts of less than 12 weeks are not eligible for this benefit.
2.4 K11DS reserves the right to suspend, cancel or terminate any staff membership of the Design Store at any time for any reasons without prior notice to the Employees.
3. The Staff Discount
3.1 The Staff Discount is only applicable to designated products as displayed on the K11DS Website (the “Designated Products”) K11DS shall have the right and sole discretion to add, remove, exclude or amend any items on the list of Designated Products.
3.2 The available period of Staff Discount for different Designated Products may vary, and such period is subject to change by K11DS at any time without any prior notice to the Employee.
3.3 Each Employee is allocated a maximum annual discount allowance of HK$60,000 (“Allowance”). The Allowance applies to the calendar year starting from 1 January and will be renewed at the beginning of each calendar year. The Allowance must be used within one year. Any Allowance not used by the end of the year will be deemed forfeited and cannot be carried forward to the next calendar year.
3.4 Additional terms and conditions on Staff Discount may be imposed on specific Designated Products. The Staff Discount cannot be used in conjunction with other promotional offers or discounts of the Designated Products.
3.5 Goods and services which the Staff Discount are applicable are sold or provided on a first-come-first-served basis and shall be available while stock lasts.
3.6 K11DS reserves the right to adjust, suspend, cancel or terminate the Staff Discount at any time without prior notice to the Employee. In case of any dispute, the decision of K11DS shall be final and conclusive.
4. Designated Products Purchased with Staff Discount
4.1 Employees are not allowed to resell or arrange for the resale of Designated Products purchased with Staff Discount from the K11DS Website.
4.2 If an Employee is found to be purchasing Designated Products and reselling them for their own personal gain, the Employee is in breach of these Terms and is liable to be disciplined.
4.3 The Replacement & Return Policy as set out in the Terms and Conditions of E-Shopping for K11DS (https://www.k11designstore.com/terms-and-conditions) shall apply to the Designated Products purchased with Staff Discount.
5. Disclaimer and Exclusion of Liability
5.1 K11DS (including any of its officers, employees or agents) gives no representation, warranty or guarantee or assume any liability of any kind in respect of the Designed Products with regard to merchantability, fitness for a particular purpose, quality and condition. Except as required by local laws, any warranty of any kind whatsoever is excluded by this paragraph to the fullest extent.
5.2 K11DS uses reasonable endeavors to update the list of Designated Products or the status of the Designated Products on the K11DS Website in a timely manner, however, there may be at times unintentional technical error or factual inaccuracies and typographical errors in the list or the online status of the Designated Products. K11DS does not warrant the accuracy, completeness, reliability and timeliness of the list of Designated Products or the status of Designated Products displayed on the K11DS Website, and K11DS expressly disclaims liability for errors or omissions in the list or the K11DS Website.
5.3 In case of any non-delivery of products purchased from the K11DS Website or the products an Employee has purchased become out of stock after the Employee has completed the purchase on the K11DS Website, K11DS’s liability shall be restricted to the refund of the purchase price of the purchased product or the replacement of the exact or similar products depending on the product’s availability.
If any part of these Terms are found by any court to be invalid, illegal or unenforceable, that part shall be disregarded and the rest of these terms shall continue to be valid to the fullest extent permitted by the applicable laws.
7. Collection of Personal Data
By agreeing to these Terms by checking the box at the bottom, you consent that K11DS may use and may transfer your personal data to the New World Group for their use in direct marketing. You may modify your personal data provided to K11DS for marketing purposes at any time by contacting K11DS’s Personal Data Privacy Officer at firstname.lastname@example.org.
8. Governing Law
These Terms and any matters connected shall be governed and interpreted by the laws of Hong Kong SAR. By registering and making purchase on the K11DS Website, you shall be deemed to have accepted these Terms and the exclusive jurisdiction of the Hong Kong courts.
No failure or delay to exercise any right or remedy provided under these Terms shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.
10. Third Party Right
Notwithstanding any other clauses of these Terms, any person who is not a party, except authorised agents of K11DS, shall not have any right under the Contracts (Rights of Third Parties) Ordinance (Cap.623) of the laws of Hong Kong SAR to enforce these Terms. For the avoidable of doubt, this clause does not affect any right or remedy of a third party which exists or is available apart from the said Ordinance.
11. Force Majeure
K11DS shall not be responsible or liable for any failure to meet any obligation under these Terms which is caused by a “Force Majeure Event”. A “Force Majeure Event” means an event or circumstance beyond the reasonable control of K11DS or the Employee which they are unable to foresee, prevent or overcome and which results in it being unable to observe or perform an obligation under these Terms. Such circumstances shall include but not be limited to acts of God, floods, fires, explosions or other catastrophes, lightning strikes, earthquakes, storms, and any other natural disaster; expropriation or confiscation of facilities, war, hostilities, rebellion, terrorist activity, military or usurped power, civil commotion, revolution, invasion, acts of foreign enemies, insurrection, sabotage or riots; local or national emergency, or strike, lockout, labour unrest, power failures or communications line or network failures, abnormal transmission or transmission interruption, other industrial disturbances which are not the fault of K11DS or the Employee.
